LOTTE Championship is an on-line information and communication service provided by 141 Hawaii LLC (dba 141 Premiere Sports & Entertainment) on behalf of Daehong Communications and One O One Communications, as agent for disclosed principals, and not as principal. Headquartered in Honolulu, Hawaii, 141 Premiere is a wholly-owned subsidiary of UK-based WPP Company. Use of the LOTTE Championship Internet Website (the “LOTTE Championship Website") signifies user agreement to the terms and conditions of use set forth below in the Agreement.
User acknowledges careful reading of this Agreement and acceptance of the terms hereof. If user does not agree to these terms and conditions of use, user may not access or otherwise use the LOTTE Championship Website and should use the browser back button to exit the LOTTE Championship Website.
We may monitor user use of this LOTTE Championship Website, and may freely use and disclose any information and materials received from user or collected through user access of the LOTTE Championship Website for any lawful reason or purpose. 141 Premiere has a specific Privacy Policy that describes the information 141 Premiere collects from users of the LOTTE Championship Website and the limitations 141 Premiere agrees to place on its use of such information. Copyright
The LOTTE Championship Website is protected by copyright as a collective work and/or compilation, pursuant to U.S. copyright laws, international conventions, and other copyright laws. The contents of the LOTTE Championship Website ("Content") are only for user’s personal, non-commercial use. Many materials contained on the LOTTE Championship Website are protected by copyright, and are owned or controlled by Daehong Communications or One O One Communications, or the party credited as the provider of the Content. User agrees to abide by any and all additional copyright notices, information, or restrictions contained in any Content on the LOTTE Championship Website. Copying or storing of any site Content for other than personal, non-commercial use is expressly prohibited without prior written permission from 141 Premiere or the copyright-holder identified in the individual Content's copyright notice.
Certain public documents may be made available on the LOTTE Championship Website. Although 141 Premiere attempts to reflect those public documents accurately on the LOTTE Championship Website, 141 Premiere is not responsible for any errors or omissions that may occur in its reporting of those public documents. Trademarks
User acknowledges that the LOTTE Championship Website may include certain trademarks and service marks owned by various parties as well as trademarks owned by other information providers. User agrees not to copy, use or otherwise infringe upon these trademarks or service marks. User further agrees that no alteration or removal of any trademark, copyright, or other notice will be made in any copies, extractions or usage of the Content.
Changes To Terms and Conditions and the LOTTE Championship Website
141 Premiere reserves the right, in its sole discretion, to change, modify, add or remove any portion of this Agreement, in whole or in part, at any time. Notification of changes in the Agreement will be posted on the LOTTE Championship Website. Continued usage of the LOTTE Championship Website or any of its services will mean user accepts those changes.
141 Premiere may also change, suspend or discontinue any aspect of the LOTTE Championship Website at any time, including the availability of any LOTTE Championship Website feature or Content. 141 Premiere may also impose limits on certain features and services or restrict user access to parts or all of the LOTTE Championship Website without notice or liability. It reserves the right to make changes, corrections, and improvements to the LOTTE Championship Website at any time without notice.
Representations of Use
User represents, warrants and covenants that: (a) user will not upload, post or transmit to or distribute or otherwise publish through the LOTTE Championship Website any materials which, (i) restrict or inhibit any other user from using and enjoying the LOTTE Championship Website, (ii) are unlawful, threatening, harassing, abusive, libelous, defamatory, obscene, vulgar, offensive, pornographic, profane, sexually explicit or indecent, (iii) constitute or encourage conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate law, (iv) violate, plagiarize or infringe the rights of third parties including, without limitation, copyright, trademark, patent, rights of privacy or publicity or any other proprietary right, (v) contain a software virus or other harmful component, including, without limitation, viruses or components designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment, (vi) contain any information, software or other material of a commercial nature, (vii) contain advertising of any kind, or (viii) constitute or contain false or misleading indications of origin or statements of fact; or (ix) solicit personal information from anyone under the age of 16; and (b) that user is at least sixteen (16) years old, and, if under eighteen (18) years old, have or possess legal parental or guardian consent to use the LOTTE Championship Website. 141 Premiere may delete any content that in its sole judgment may be offensive, illegal, or inappropriate, or which otherwise violates these Terms and Conditions. 141 Premiere assumes no responsibility for the content or material posted on the LOTTE Championship Website, no obligation to monitor inappropriate content and has no responsibility for the conduct of any user submitting offensive, illegal, or otherwise inappropriate content or material on or to the LOTTE Championship Website. User shall assume sole liability and responsibility for any content, material, or information that user posts or transmits on or through the LOTTE Championship Website.
Indemnification
User hereby agrees to indemnify, defend and hold 141 Hawaii LLC (dba 141 Premiere Sports & Entertainment), LOTTE, Daehong Communications and One O One Communications, and all its officers, directors, owners, agents, employees, information providers, affiliates, licensors and licensees and the assigns of the same (collectively, the "Indemnified Parties") harmless from and against any and all liability and costs incurred by the Indemnified Parties in connection with any claim arising out of any breach by user of the Agreement or the foregoing representations, warranties and covenants, including, without limitation, attorneys' fees and costs. User agrees to cooperate as fully as reasonably required in the defense of any claim. 141 Premiere reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by user and user shall not in any event settle any matter without the written consent of 141 Premiere.
